1. Acceptance of Terms

These Terms of Service form a binding agreement between you and ServiceHero AI, Inc. regarding your use of ServiceHero AI, including the website, contractor-facing application at app.service-hero.ai, and related services. If you do not agree to these terms, do not use the service.

2. Service Description

ServiceHero AI provides AI-assisted call answering and intake tools designed for home services contractors. The service may answer inbound calls, collect caller details, summarize conversations, route follow-up information, and provide related account management features.

The service is intended to support your customer communications workflow. You remain responsible for your business operations, customer relationships, scheduling, pricing, regulatory compliance, and any commitments made to your customers.

3. Account Registration and Responsibilities

• You must provide accurate and current account information.
• You are responsible for safeguarding account credentials and restricting unauthorized access.
• You are responsible for all activity under your account, including call forwarding configurations and user permissions.
• You must promptly notify ServiceHero AI, Inc. at [email protected] if you suspect unauthorized access or a security issue.

4. Subscription Plans and Billing

ServiceHero AI is offered on a subscription basis. Current standard plans are listed below and may be updated from time to time.

• Fees are billed in advance on a recurring basis unless otherwise agreed in writing.
• You authorize ServiceHero AI, Inc. to charge the payment method on file for applicable subscription fees, taxes, and approved overage or add-on charges.
• Except as required by law, fees are non-refundable once billed.
• If payment is late or fails, we may suspend or limit access until the account is brought current.

5. Acceptable Use

You agree not to use ServiceHero AI to:

• Violate any law, regulation, or third-party right.
• Transmit unlawful, deceptive, abusive, infringing, or harmful content.
• Interfere with, disrupt, probe, or attempt unauthorized access to the service or related systems.
• Use the service for spam, fraud, harassment, or deceptive robocalling activity.
• Misrepresent the capabilities or identity of ServiceHero AI in a way that is unlawful or misleading.

6. Call Recording and Data Handling

ServiceHero AI may process call audio, transcripts, caller-provided information, account data, and related metadata to provide the service, improve performance, support operations, and maintain security. Depending on your configuration, calls may be recorded or transcribed.

You are responsible for providing any notices or obtaining any consents required under applicable law for call recording, monitoring, transcription, or AI-assisted communications. You represent that you have the right to direct ServiceHero AI, Inc. to process information submitted through the service on your behalf.

ServiceHero AI, Inc. will handle service data in accordance with its operational practices and may use vendors and subprocessors to host, process, transmit, or secure that data.

7. Intellectual Property

ServiceHero AI, Inc. and its licensors retain all rights, title, and interest in ServiceHero AI, including the software, models, workflows, branding, website content, and related intellectual property. These terms do not transfer any ownership rights to you.

Subject to these terms and your payment of applicable fees, ServiceHero AI, Inc. grants you a limited, non-exclusive, non-transferable right to use the service for your internal business purposes during the subscription term.

8. Service Availability

We aim to make ServiceHero AI available on a reliable, ongoing basis, but the service is provided on an as-available basis. At this stage, ServiceHero AI, Inc. does not offer a formal service level agreement or guaranteed uptime commitment unless expressly agreed in writing.

Maintenance, third-party outages, telecom issues, infrastructure failures, or other events may affect availability, latency, or functionality.

9. Limitation of Liability

To the fullest extent permitted by law, ServiceHero AI, Inc. and its affiliates, officers, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, customers, or business opportunities arising from or related to the service.

To the fullest extent permitted by law, ServiceHero AI, Inc.'s total liability arising out of or related to these terms or the service will not exceed the amount you paid to ServiceHero AI, Inc. for the service during the three months preceding the event giving rise to the claim.

10. Termination

You may stop using the service at any time and may cancel your subscription subject to any applicable billing commitments. ServiceHero AI, Inc. may suspend or terminate access if you violate these terms, fail to pay amounts due, create risk for the service or others, or if we discontinue the service.

Upon termination, your right to use ServiceHero AI will end, though provisions that by their nature should survive termination will remain in effect.

11. Changes to Terms

ServiceHero AI, Inc. may update these Terms of Service from time to time. Updated terms will become effective when posted on this page unless stated otherwise. Your continued use of ServiceHero AI after updated terms take effect constitutes acceptance of the revised terms.

12. Governing Law

These terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. Any dispute arising out of or relating to these terms or the service will be brought in the state or federal courts located in or serving San Antonio, Texas, and you consent to that venue and jurisdiction.
